Dear FoI coordinator,

Please could you tell me, for each Trust in the SHA area, what percentage of slots were unavailable when booking was attempted through Choose and Book in each of the last 20 weeks for which figures

are available.

Freedom of Information

I refer to your email of 19 February asking:-

‘Please could you tell me, for each Trust in the SHA area, what percentage of slots were unavailable when booking was attempted through Choose and Book in each of the last 20 weeks for which figures are available’.

I can confirm in accordance with S.1 (1) of the Freedom of Information Act 2000 that we do hold the information that you have requested.  However, it has been estimated that the time it will take to undertake the necessary search, retrieval and preparation work that will enable us to respond fully to your request will exceed the Appropriate Limit as set out in the Freedom of Information Fee and Appropriate Limit Regulations.  Therefore, under section 12 of the Freedom of Information Act we are not obliged to comply with your request and will not be processing your request further.

For information purposes, the Fee Limit set down by the Lord Chancellor is £450 equating to a maximum of 18 hours of search and retrieval time charged at £25.00 per hour.    Please see the attached link to our website:-

When working out the Appropriate Fee Limit, we have taken into account:

·        determining whether NHS East Midlands holds the information;

·        locating the information;

·        retrieving the information; and

·        extracting and formatting the information

However I am able to advise you that NHS East Midlands is aware of concerns in respect of the choose and book system and I would advise you that we have recently advised  our commissioners  to  use  the levers in the contracts to improve performance by providers in making slots available on the choose and book system.

I should also advise you that were you to make a revised request, this might fall under the statutory limit.
